⚖️Make Criminal Law a Game [ ✨ START PLAYING ✨ ]⚖️ Go deeper with an interactive companion guide from The Law School of America. 👉 🚀 Open the Interactive📖 Book Guide📖 and sharpen your understanding! 👈 🎧 EPISODE SUMMARY 🎧Crimes against the person are categorized by the severity of harm and the defendant's mental state.Homicide requires the unlawful killing of a human being resulting in brain death or respiratory/circulatory failure.Common law murder is an unlawful killing with malice aforethought, satisfied by four mental states:1. Intent to kill.2. Intent to inflict great bodily harm.3. Depraved-heart murder (reckless indifference to human life).4. Felony murder (unintended killing during an inherently dangerous felony like BARRK: Burglary, Arson, Rape, Robbery, Kidnapping).Murder defaults to second-degree unless elevated to first-degree by premeditation/deliberation, enumerated felonies, or heinous means.Voluntary manslaughter is intentional killing mitigated by heat of passion from adequate provocation or imperfect self-defense.Involuntary manslaughter is unintentional killing caused by criminal negligence or during a misdemeanor. The Model Penal Code categorizes homicide into Murder (extreme indifference), Manslaughter (recklessness or EMED), and Negligent Homicide.Non-fatal offenses include Battery (unlawful application of force), Mayhem (permanent disfigurement), and Assault (attempted battery or creating apprehension of harm).False imprisonment is unlawful confinement, while Kidnapping adds movement or concealment. Rape is non-consensual sexual penetration, and Statutory Rape is strict liability based on age.Key grading steps for homicide analysis:1. Test common law murder malice states.2. Check statutory first-degree murder elevation.3. Evaluate mitigation to voluntary manslaughter.4. Consider involuntary manslaughter or negligent homicide if malice is absent.Following this hierarchy captures all theories of liability and mitigation.ℹ️ INFORMATION, PRIVACY POLICY & TERMS OF USE ℹ️The Podcast and Website PurposeThe Law School Podcast and 1L Study Aide webpage supplements law-school and Bar Exam study with strategies, condensed rules, quizzes, and flashcards.Educational DisclaimerContent is for educational and informational purposes only. ⚖️Make Criminal Law a Game [ ✨ START PLAYING ✨ ]⚖️ Go deeper with an interactive companion guide from The Law School of America. 👉 🚀 Open the Interactive📖 Book Guide📖 and sharpen your understanding! 👈 🎧 EPISODE SUMMARY 🎧Criminal law analysis begins by breaking an offense into its foundational elements and testing each requirement in sequence.Punishment rests on four philosophical pillars: retribution (backward-looking moral desert) and the three utilitarian goals of deterrence (specific and general), incapacitation, and rehabilitation. The principle of legality forbids retroactive criminalization (ex post facto laws) and invalidates statutes that fail to give ordinary citizens fair notice or that invite arbitrary police enforcement (void-for-vagueness). Under the rule of lenity, intractable statutory ambiguity is resolved in the defendant’s favor.Every crime requires an actus reus—either a voluntary physical act (a willed bodily movement, excluding reflexes, convulsions, sleepwalking, or unconsciousness) or an omission accompanied by a specific legal duty to act (arising from statute, status relationship, contract, voluntary assumption of care, or creation of the peril), plus knowledge of the facts and the ability to perform. Mere status (such as addiction) cannot be criminalized, though possession (actual or constructive) satisfies actus reus.At common law, mens rea falls into four categories:Specific intent (inchoate crimes, premeditated murder, theft offenses, burglary, assault), which uniquely allows defenses of voluntary intoxication and unreasonable mistake of fact. The Model Penal Code replaces common law mental states with four hierarchical levels applied to each conduct, circumstance, or result element: purposely (conscious object), knowingly (awareness or practical certainty, including willful blindness), recklessly (conscious disregard of a substantial and unjustifiable risk), and negligently (objective failure to perceive a substantial and unjustifiable risk). When an MPC statute is silent on mens rea, recklessly is the default minimum, and any stated mens rea travels to all material elements unless a contrary purpose plainly appears.Under concurrence, the mens rea must exist at the moment of the actus reus and must motivate the act. Under transferred intent, an intent to harm one victim transfers to an unintended victim who suffers the same type of harm, supporting convictions for both attempt against the target and the completed crime against the actual victim.Result crimes require both actual causation ("but-for" cause or substantial factor in accelerating the harm) and proximate causation (foreseeability). Pre-existing victim vulnerabilities (eggshell skull) never break the chain of causation. Dependent (responsive) intervening causes break the chain only if abnormal or bizarre (such as gross medical malpractice, not ordinary negligence), whereas independent (coincidental) intervening causes break the chain unless they were foreseeable.ℹ️ INFORMATION, PRIVACY POLICY & TERMS OF USE ℹ️The Podcast and Website PurposeThe Law School Podcast and 1L Study Aide webpage supplements law-school and Bar Exam study with strategies, condensed rules, quizzes, and flashcards.Educational DisclaimerContent is for educational and informational purposes only. Issue preclusion prevents relitigation of an identical issue actually litigated, determined, and essential to a qualifying judgment, subject to opportunity and fairness requirements. Nonparty binding requires a recognized justification; nonmutual use requires separate analysis. An integrated examination answer follows the case's procedural stage, checks each doctrine's prerequisites, and states precisely what the court should do next.ℹ️ INFORMATION, PRIVACY POLICY & TERMS OF USE ℹ️The Podcast and Website PurposeThe Law School Podcast and 1L Study Aide webpage supplements law-school and Bar Exam study with strategies, condensed rules, quizzes, and flashcards.Educational DisclaimerContent is for educational and informational purposes only.
